The Tradie Kit Pty Ltd ACN 682 427 532 trading as “TradieKit” (we, us, our) operates the TradieKit digital platform, including any website, mobile application, software and related services made available by us from time to time (Platform).

This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with the Platform. It applies to users of the Platform and visitors who interact with us in connection with the Platform. It does not apply to the separate TradieKit online store or the sale and delivery of physical products through that store.

We handle personal information in accordance with applicable privacy laws. Where the Privacy Act 1988 (Cth) applies to us, we will handle personal information in accordance with that Act and the Australian Privacy Principles.

We may also provide a privacy collection notice when we collect particular information. Any collection notice should be read together with this Privacy Policy.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to the Platform, our information-handling practices, legal requirements or our business. The updated version will be published on the Platform and will take effect from the date stated in the updated Privacy Policy.

Personal information

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

The types of personal information we may collect and hold include:

• your name, contact details, business details, trade or occupation and account information;

• login details, authentication information and account preferences;

• job, project, customer or client information that you enter or upload through the Platform;

• notes, photographs, documents, records and other content that you upload through the Platform;

• payment, subscription and billing information where you use a paid feature;

• communications, enquiries, complaints, support requests and feedback;

• notification preferences and information about how you interact with reminders, alerts and messages;

• device identifiers, IP address, browser type, operating system, application version, log data, crash data, analytics data and information about how you use the Platform; and

• other information reasonably necessary to provide, administer, secure or improve the Platform.

You are not required to provide personal information to us. However, if you do not provide information we reasonably require, we may be unable to provide some or all Platform functionality.

Information about other people

The Platform may allow you to enter or upload personal information about customers, clients, workers, property owners or other people. If you provide personal information about another person, you must ensure that you are authorised to do so and have any consent required by law. You should also make that person aware of this Privacy Policy or any relevant collection notice where reasonably practicable.

You remain responsible for ensuring that information about another person is reasonably necessary for your use of the Platform and is collected, used and disclosed lawfully.

Sensitive information

We do not ordinarily require you to provide sensitive information. However, information uploaded through the Platform, including photographs, notes or workplace records, may contain sensitive information.

You should only provide sensitive information where it is reasonably necessary for your use of the Platform and you have the authority and any consent required to provide it. We will collect and handle sensitive information only where permitted by law.

How we collect personal information

We may collect personal information:

• when you create, manage or use an account;

• when you enter or upload information through the Platform;

• when you enable an integration or connect the Platform with another service;

• when you purchase or subscribe to a paid feature;

• when you contact us, request support, provide feedback or make a complaint;

• automatically through cookies, software development kits, pixels, analytics tools, logs and similar technologies;

• from application stores, payment providers, authentication providers and other service providers used to operate the Platform; and

• from another person or organisation where they are authorised to provide the information to us.

How we use personal information

We may collect, hold, use and disclose personal information for purposes including:

• creating, administering and securing accounts;

• providing, operating, maintaining and supporting the Platform;

• storing and processing information entered or uploaded through the Platform;

• providing reminders, alerts, push notifications, articles and other Platform communications;

• administering subscriptions, paid features and payments;

• responding to enquiries, support requests, complaints and disputes;

• personalising, analysing, troubleshooting, developing and improving the Platform;

• detecting, investigating and preventing fraud, misuse, security incidents and unlawful activity;

• communicating with you about the Platform, our services and changes to our terms or policies;

• enforcing our agreements and protecting our rights, users and legitimate business interests;

• complying with legal, regulatory and contractual obligations; and

• other purposes disclosed to you at the time of collection or otherwise permitted by law.

We may use aggregated or de-identified information for analytics, research, reporting and product development where that information does not reasonably identify an individual.

Cookies, analytics and mobile application information

We may use cookies, software development kits, pixels, analytics tools, crash-reporting tools, device identifiers and similar technologies to operate, secure, analyse and improve the Platform. These technologies may collect information about your device, browser, operating system, application version, IP address, approximate location, network connection and use of the Platform.

You may be able to manage cookies through your browser settings and mobile permissions through your device settings. Disabling cookies or permissions may affect the availability or operation of parts of the Platform.

Where the Platform sends push notifications, we or our service providers may collect and use notification tokens and preferences to deliver and manage those notifications. You can generally manage push notifications through the Platform or your device settings.

Direct marketing

We may use personal information to send you newsletters, promotional material, information about new features or other direct marketing communications where permitted by law.

You may opt out of direct marketing at any time by using the unsubscribe option in the relevant communication or by contacting us. If you opt out, we may still send service, security, account, billing or other non-marketing communications.

Disclosure of personal information

We may disclose personal information to third parties that assist us to operate, administer, secure, improve or support the Platform, including:

• cloud-hosting, storage and infrastructure providers;

• developers, contractors and technical support providers;

• analytics, monitoring, logging and error-reporting providers;

• email, SMS, push-notification, communications and customer-support providers;

• authentication, identity and account-management providers;

• payment processors and application-store providers;

• third-party integration providers and services that you choose to connect with the Platform;

• professional advisers, including lawyers, accountants, auditors and insurers;

• regulators, authorities, courts, law-enforcement bodies and dispute-resolution bodies where required or permitted by law;

• a purchaser, investor, financier or successor in connection with a proposed or completed sale, restructure or transfer of our business or assets; and

• other service providers reasonably necessary to operate the Platform.

We may also disclose personal information where you direct or authorise us to do so, for a related purpose that you would reasonably expect, or where otherwise permitted or required by law.

Third-party integrations and services

The Platform may connect with or contain links to third-party services. If you enable an integration, we may disclose information to, or receive information from, the relevant third party. The information exchanged will depend on the integration and the permissions you grant.

Third-party services are governed by their own terms and privacy policies. You should review those terms and the permissions requested before enabling an integration. We are not responsible for how an independent third party handles personal information once it is disclosed to or collected by that third party, except to the extent required by law.

Overseas storage and disclosure

We may store and process personal information in Australia and overseas, including through service providers, contractors and technical support personnel used to operate and support the Platform.

The countries involved may vary depending on the providers we use. Where required by applicable law and practicable, we will identify the principal countries in which overseas recipients are likely to be located. Where required by law, we will take reasonable steps to ensure that overseas recipients handle personal information consistently with applicable Australian privacy requirements.

How we store and protect personal information

We may store personal information in electronic systems, databases, cloud infrastructure, application systems, support tools and backups used to operate the Platform.

We take reasonable steps appropriate to the circumstances to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. The measures we use may change over time having regard to the nature of the information, the Platform and the risks involved.

No method of electronic transmission or storage is completely secure, and we cannot guarantee the absolute security of information transmitted to or stored through the Platform.

Retention and deletion

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including to operate and support the Platform, maintain business records, resolve disputes, comply with legal obligations and enforce our agreements.

When personal information is no longer reasonably required, we may destroy or de-identify it, subject to applicable law and our reasonable operational requirements. Closing an account or ceasing to use the Platform does not necessarily require us to delete information immediately.

Accessing and correcting personal information

You may request access to personal information we hold about you and ask us to correct that information if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading.

We will respond within a reasonable period and in accordance with applicable law. We will not charge a fee for making a request, but may charge a reasonable fee for providing access where permitted by law.

In some circumstances, we may refuse access or correction, or provide access in a particular way, where permitted by law. If we refuse a request, we will provide reasons where required by law.

Anonymity and pseudonymity

Where lawful and practicable, you may interact with us anonymously or using a pseudonym, for example when browsing publicly available information or making a general enquiry. However, we generally need information that identifies you to create an account and provide key Platform functionality.

Children

The Platform is intended for persons aged 18 years or older. We do not knowingly allow a person under 18 to create an account. If you believe that a person under 18 has provided personal information to us without appropriate authority, please contact us.

We will acknowledge and investigate a complaint within a reasonable period. If we consider that a complaint is well founded, we will take reasonable steps to address it.
